I. Preparation Phase

  • Engagement / commissioning
  • Information gathering and preliminary review
  • Contacting the parties – if applicable, a preparatory meeting with the (individual) parties
  • Clarifying the mandate
  • Mediation agreement

II. Mediation Phase – Mediation Discussion

  • Introduction
  • Positions / problem definition / agenda
  • Clarifying the conflict and interests
  • Developing options / negotiations
  • Problem-solving / agreement

III. Post-Mediation Phase / Implementation Phase

  • Review of the agreement by third parties (e.g. the parties’ lawyers)
  • If applicable, formal recognition and ratification (e.g. notarial certification, court)
  • Monitoring compliance with the agreement
  • Mediators’ reflection / debriefing
  • If applicable, follow-up
