Successful cooperation has many facets, including quite a few legal ones1. Here, I would like to focus in particular — from a legal perspective — on the genuinely cooperative aspect of collaboration: more precisely, on trust-stabilizing clauses in long-term cooperative contractual relationships and in corporate-law affiliations, and their application — especially for acting online.
So the focus here is not primarily on how to best safeguard one’s own rights and one’s own benefit alone, but rather on questions such as:
- How can matters be regulated bindingly so that the collaboration can succeed as well as possible?
- How are these rules applied within the framework of a cooperation?
- How are such cooperative clauses further developed during the course of the collaboration?
