Its main basis is the German Act against Unfair Competition (UWG).<\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">It usually starts with a cease-and-desist letter (Abmahnung). A competitor or an association demands that you stop an advertisement, a statement in your online shop or a business practice, and sets a short deadline for doing so. Or the other way round: a competitor gains an advantage by unfair means, and you do not want to accept that. I represent companies on both sides, those sending and those receiving cease-and-desist letters, out of court and before the courts. This includes companies based abroad that sell to customers in Germany.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"font-size:1.5rem\">You have received a cease-and-desist letter<\/h2>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">A cease-and-desist letter usually sets a short deadline and contains a pre-drafted declaration to cease and desist with a contractual penalty. I examine for you:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>whether the allegation is correct and the letter meets the legal requirements,<\/li>\n\n\n<li>whether the sender is entitled to send it at all and whether there are signs of abuse,<\/li>\n\n\n<li>whether, and in what amount, you have to reimburse costs,<\/li>\n\n\n<li>what a declaration could look like that ends the matter without binding you more than necessary,<\/li>\n\n\n<li>whether a protective letter (Schutzschrift) against a preliminary injunction makes sense.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">I then negotiate with the other side or represent you in court.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"font-size:1.5rem\">You want to take action against a competitor<\/h2>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Anyone who tolerates unfair competition loses customers to competitors who do not play by the rules. Together with you, I secure the evidence, send a cease-and-desist letter and enforce your claim to injunctive relief, if necessary in summary proceedings by way of a preliminary injunction. Considerably stricter rules apply from 27 September 2026.<\/li>\n\n\n<li><strong>Customer reviews<\/strong> \u2013 authenticity, bought or filtered reviews and the mandatory notices on them.<\/li>\n\n\n<li><strong>Influencer and affiliate marketing<\/strong> \u2013 when posts must be labelled as advertising.<\/li>\n\n\n<li><strong>Comparative advertising<\/strong> \u2013 what is permitted and where the disparagement of competitors begins.<\/li>\n\n\n<li><strong>Mandatory information in online shops<\/strong> \u2013 imprint, withdrawal notice, order and cancellation buttons, T&amp;Cs.<\/li>\n\n\n<li><strong>Advertising by e-mail, telephone and messenger<\/strong> \u2013 consent, newsletters, unsolicited advertising calls.<\/li>\n\n\n<li><strong>Marketplaces and platforms<\/strong> \u2013 offers on Amazon, eBay and other platforms, product information and the seller\u2019s responsibility.<\/li>\n\n\n<li><strong>Breach of statutory rules as unfair competition<\/strong> \u2013 when competitors pursue breaches of, for example, labelling, product safety or accessibility requirements.<\/li>\n\n\n<li><strong>Data protection in competition<\/strong> \u2013 when competitors send cease-and-desist letters over data protection breaches.<\/li>\n\n\n<li><strong>Imitation of products<\/strong> \u2013 protection against copies even without a registered right.<\/li>\n\n\n<li><strong>Trade secrets<\/strong> \u2013 protection of know-how, customer lists and calculations, also against former employees.<\/li>\n\n\n<li><strong>Obstruction of competitors<\/strong> \u2013 targeted poaching, diverting customers, misuse of trade marks and domains.<\/li>\n\n\n<li><strong>Prize games and discount campaigns<\/strong> \u2013 terms of participation and transparency.<\/li>\n\n\n<li><strong>Health-related advertising<\/strong> \u2013 advertising for products with a health connection.<\/li>\n\n\n<li><strong>Antitrust law in distribution<\/strong> \u2013 resale price requirements, platform bans and other restrictions in distribution agreements.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"font-size:1.5rem\">Typical issues<\/h2>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Often the question is<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>whether, and in what form, a declaration to cease and desist is given and what the contractual penalty means,<\/li>\n\n\n<li>what happens when the deadline in a cease-and-desist letter expires,<\/li>\n\n\n<li>who bears the lawyer\u2019s fees for the cease-and-desist letter,<\/li>\n\n\n<li>whether a cease-and-desist letter is abusive,<\/li>\n\n\n<li>how quickly anyone wanting to send a cease-and-desist letter or obtain a preliminary injunction must act.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"font-size:1.5rem\">How to get started<\/h2>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Send me the cease-and-desist letter or a short description with screenshots by e-mail.
